Summary

Problem hedges are a high profile issue that, in extreme cases, can lead to violent disputes between neighbours. This section explains the common law position and remedies available to a property owner in relation to problems associated with neighbouring hedges. It explains the history of attempts to develop legislation to address the issue of problem hedges, and the key provisions of Part 8 of the Anti-social Behaviour Act 2003, which now provides a means to deal with these problems. Also covered is government guidance that seeks to help avoid neighbour disputes over this issue, including the Building Research Establishment guidance on calculating hedge heights, which is of valuable assistance to practitioners who advise clients on a hedge dispute.
